On November 7, 2023, China officially joined the Hague Apostille Convention. Processing documents for China only requires the apostille through the state and no longer requires the multi-step legalization process. For U.S. federal documents (Example: FBI background check for China), an apostille from the U.S. Department of State will also be accepted, eliminating the need for legalization by the Chinese Embassy or Consulate office.
This change follows China’s official accession to the Convention of October 5, 1961, known as the “Apostille Convention,” on March 8, 2022. This membership simplifies the process for companies and individuals, as documents destined for China will no longer require multiple rounds of authentication by various authorities, previously known as the Legalization Process.
An Apostille is a specialized certificate issued by the Secretary of State, which is attached to the original document to verify its legitimacy and authenticity, ensuring acceptance in countries that are members of the Hague Apostille Convention.
In the United States, all 50 states, the District of Columbia, and the Federal Government (U.S. Department of State – Office of Authentication) are authorized to issue Apostilles. As of November 7, 2023, with China’s participation in the Hague Apostille Convention, any official document intended for China will need an apostille from the Secretary of State’s office.
